CONFIDENTIALITY AND PRIVACY POLICIES
For CreateSoftApp, privacy and the handling of your information are of utmost importance. Therefore, we have established the following policies through which we will inform you about the principles governing them, the treatment we give to the information, the different sources of information we consult, and the uses we give to your data so that you are always informed. These confidentiality and privacy policies are directed to all natural or legal persons who use the services offered by CreateSoftApp, hence we suggest you read them fully and carefully. It is possible that CreateSoftApp may need to update or modify these privacy policies, which will be informed to users through the website (see publication date or last update) and, if necessary, renew your consent through an email you will be informed in order to update your registration with the new version. Keep in mind that it is not mandatory to accept these terms for the processing of your information, but by not being able to access your information or consult it, there are services that will not be available to you, however, when these are accepted we will have understood that you read and agreed with our policies.

SOURCES OF INFORMATION:
Next, we will tell you what are the channels through which we receive your information: a) The information you disclose to us: When you register on the CreateSoftApp payment platform or make use of our services, you fill out a form where you provide us with information such as your full name, document number, home address, email address, telephone or cell phone number, bank, account number; in addition to the forms, documentation supporting the veracity of the information may also be requested such as an image of the identity document, RUT image, Chamber of Commerce Certificate, or Bank Account Certificate. b) Indirect sources of information: When you register on the payment platform or make use of our services indirectly, you share with us information regarding your market preferences, payment habits, businesses you frequently purchase from, etc. c) Cookies: When you visit our website or make use of our services on your computer, information is temporarily stored on your device known as cookies, this technology allows us to offer you a smoother payment experience by not having to enter your complete data each time a payment is made allowing us to provide a better service, there are functionalities that can only be opened on your computer through cookies, however, you can delete them whenever you want from the tools available in different browsers; cookies also allow you to tokenize the information, therefore, the access to services can be much easier due to the reminder of passwords or data used in the payment forms. d) Third-party information providers: CreateSoftApp may obtain information on behalf of third parties in order to verify the authenticity of the requested operation, this information may be sociodemographic, IP address, or financial when the operation requires it, likewise, when registering businesses CreateSoftApp may consult restrictive lists or blacklists (Clinton List or INTERPOL) in order to prevent the risk of ML-FT (Money laundering and terrorism financing) as required by law. e) Through registered businesses: It is possible that through payment orders generated directly by businesses we obtain personal information without your consent, therefore you should always verify with your providers or in the online stores you visit the protection of privacy and confidentiality since in this case the responsible for the handling of your information and confidentiality is the one who received the information.
INFORMATION TREATMENT AND PURPOSE:
In accordance with our policies for the protection of privacy and confidentiality and Colombian law, next, we will tell you what is the treatment that CreateSoftApp gives to your information and its respective purposes. a) In compliance with Law 1480, article 53, the business that wishes to register to make use of the electronic payment platform services and charge for its products will have the duty to enter a minimum contact data which will be visible on the payment portal or checkouts for the full identification of the business by the customers. b) When a Billing or Payment request is generated CreateSoftApp will send your information to low-value payment networks, acquiring bank, and other entities that participate in the payment process that can be national or international, encrypted so that it can only be treated by the recipient and for the purposes it was disclosed. This process is necessary to be able to process Billing - Charging requests or dispute resolution, but you can rest assured, these third parties to whom we send your information to process such requests are companies that comply with high standards of quality in information security and are generally monitored by governmental control bodies. c) The information you share with us or we consult with your authorization helps us protect you from electronic crimes, fraud, or impersonation, this information may be analyzed by our fraud prevention monitoring system or by authorized and highly qualified personnel to analyze such data and even contact you to confirm your authorization; these communications may be recorded and monitored to verify compliance with security standards and verify the authenticity of your acceptance. d) The shared information will be stored in our database to be treated in future transactions in order to confront the information in new payments, improve our quality standards in the security of transactions, catalog your preferences to provide information of interest with advertising, promotional, or informational contents and send notifications about the status of the requests made to CreateSoftApp, these requests may refer to payments, complaints and claims, support tickets, withdrawal requests, among others, billing, retention certificates, etc. Likewise, take into account that the information entered in the business registration or payment forms or obtained by CreateSoftApp with authorization must remain stored in our database in order to guarantee the attention to possible controversies that may arise regarding the services provided by CreateSoftApp. e) When a payment request generates some controversy or retraction, CreateSoftApp may share your information with the entities that intervene in this process. f) CreateSoftApp may share your information with different suppliers and allies in order to guarantee the provision of service and improvement in the quality of the same, also to make you a participant and beneficiary of the different programs aimed at loyalty and portfolio complement.
CONFIDENTIALITY:
CreateSoftApp guarantees confidentiality policies on the information disclosed directly or indirectly that may reveal sensitive information and attack human dignity, likewise, CreateSoftApp will not give a different use to the announced information and will implement all the mechanisms of law and good practices that promote this practice. RIGHTS AND DUTIES AS THE HOLDER OF THE INFORMATION: The information disclosed directly or indirectly will continue to be your property, however, you must take into account the following rights and duties for the correct treatment of data and guarantee the purposes for which it was disclosed. a) Rights: To refuse to disclose your information and to be treated: Take into account that by accepting our privacy and confidentiality policies of the information you are declaring to have read and understood the entirety of this document, if you do not want this to be so, you can decline the request at any time before accepting it. Keep your contact information updated: It is very important that you keep all the information updated, thus you guarantee that all notifications that must be made will arrive in a timely manner. Prohibition of use by third parties: If you are a natural person, take into account that the opening of the account or payment requests can only be managed personally and in order to guarantee the protection of your rights it is prohibited to make requests on behalf of third parties even with authorization, therefore we inform you that requests that are not sent on behalf of the owner or it is detected that the operation is being executed by a third party will be denied. MINORS: CreateSoftApp does not collect, disclose, or treat information from minors since all services are restricted for minors. CreateSoftApp is not responsible for the unauthorized use of the payment platform or any of the services by minors using third-party information, parents are advised to supervise minors when they manipulate or have access to the Internet. DISCLAIMER: We do everything within our power and what the good industrial practices dictate, as well as the PCI-DSS so that your information is safeguarded with the best quality standards in security, however, it is possible that due to some type of external attack not foreseen or identified even by the control bodies and the industry as a vulnerability in operating systems, network standards, data encryption protocols, processors, etc, breaches in security may occur that allow the loss or leakage of your information, therefore you declare that you are aware of the risks that exist when disclosing and sharing and allowing the consultation of your information and that you exonerate CreateSoftApp from all responsibility when unforeseen situations violate your rights as the holder of the information.
